1. Acceptance of these Terms

These Terms and Conditions (“Terms”) govern access to and use of www.houseofvriksha.com (“Website”) and apply to enquiries, Everyday Wood products, bespoke furniture, interior design, execution and related services offered by the legal entity operating House of Vriksha (“HOV”, “we”, “us”, “our”). By accessing the Website, submitting an enquiry, requesting a quotation, placing an order, approving a design, making a payment or otherwise engaging with HOV, you acknowledge these Terms. A separate quotation, proposal, work order, invoice or project agreement (“Project Agreement”) may contain specific commercial terms; those specific terms govern the relevant project to the extent of any inconsistency.

2. Website purpose

 

The Website introduces HOV and facilitates enquiries. Website text, photographs, renders, dimensions, descriptions, finishes, colours, material references, indicative prices and timelines are informational and may change. An enquiry is not an order, booking, acceptance, final quotation or guarantee that HOV will undertake the requested work. A binding commitment arises only when HOV confirms it in writing and the applicable commercial documents are accepted.

3. Product images, colours and natural variation

HOV makes reasonable efforts to display products accurately. However, device screens, lighting, photography and image processing can affect appearance. Actual products may therefore differ from website photographs or displayed colours

• Wood and other natural materials may vary in grain, shade, knots, pores, texture, figuring and sheen. Natural variation is not, by itself, a defect.

• Colours, stains, laminates, fabrics and finishes shown online are indicative. Where a particular finish is critical, request and approve a physical sample/swatches where available.

• Even approved samples may not be identical across natural materials or separate pieces.

• Styled photographs may include accessories, decor, appliances or other items not included in an order unless expressly stated.

• Website dimensions may be approximate. Final approved drawings/specifications/invoices govern the applicable order.

• Project photographs and renders may show previous work or illustrative concepts; they do not mean every visible item or feature is included.

4. Everyday Wood orders

Everyday Wood products are subject to availability, production capacity and material availability. HOV may correct material, pricing, availability or description errors. An order is confirmed only after HOV accepts it and receives the applicable payment/advance. HOV may decline an order that cannot reasonably be supplied or executed, subject to applicable law and refund obligations.

5. Bespoke and made-to-order furniture

Bespoke furniture is produced for the customer's approved requirements, space and specification. Production follows the final written specification, approved drawings, dimensions, material/finish approvals and quotation.

• Customer-requested changes after approval, procurement or production may create additional design, material, labour, transport, rework or installation costs and extend timelines.

• Where customer-provided dimensions or site information are relied upon, the customer is responsible for accuracy unless HOV has expressly undertaken measurement/verification.

• Minor variations arising from material characteristics, production tolerances or practical construction requirements may occur and are not automatically defects

.• Custom/made-to-order items may not be cancellable or returnable after production/procurement begins, except where applicable law or the written agreement provides otherwise.

• Any design fees, procurement costs, cancellation charges, refunds or other consequences will be governed by the applicable quotation/Project Agreement.

6. Interior design and execution

Aadya Interior World services are limited to the scope expressly included in the applicable proposal, quotation, work order or agreement. HOV does not represent that every project includes architectural, structural, civil, electrical, plumbing, engineering or specialist services unless expressly included in writing.

• Designs, layouts, 3D views, mood boards and drawings may change as requirements, measurements, budget, materials or site conditions develop.

• Renders are representations of design intent and may not exactly reproduce final colour, material, lighting or dimensions.

• Third-party products and specialist vendors remain subject to their own availability, specifications and warranties.

• Concealed site conditions, existing defects, access restrictions, building rules, approvals and unforeseen work may affect cost and schedule and may require a written variation

.• Third-party or external work is HOV's responsibility only to the extent expressly accepted in the agreed scope.

7. Quotations, pricing and scope

Website information is not a binding price quotation. Project pricing is based on the final approved scope, specifications, quantities, materials, finishes, dimensions, site conditions, logistics, taxes and exclusions in the quotation/Project Agreement.

• Quotations may have a validity period and may be revised after expiry due to material, labour, supplier, transport, tax or other cost changes.

• Delivery, installation, storage, special access, building charges, dismantling, civil/electrical/plumbing work and other items not expressly included may be charged separately where applicable.

• Verbal discussions or informal messages do not amend an approved scope unless confirmed in writing by an authorised HOV representative.

• Customer-requested variations may change both price and timeline.

8. Payments

Payment schedules, advances and milestones are governed by the applicable quotation, invoice or Project Agreement. Subject to that agreement and law, HOV may pause design, procurement, production, delivery or installation where a payment is overdue. Applicable taxes and transaction charges will be handled as stated in the invoice/quotation.

9. Delivery, installation and handover

Delivery and installation dates are estimates unless expressly guaranteed in writing. Delays may arise from materials, suppliers, customer approvals, payment delays, changes, site readiness, access restrictions, building permissions, transport, labour availability, force majeure and other matters outside HOV's reasonable control.

• Customers must provide safe and reasonable site access and required building/society/landlord permissions allocated to them

. • Where a site is not ready or access is unavailable, storage, redelivery or additional visits may attract reasonable charges where applicable.

 

• Installation excludes civil, structural, electrical, plumbing or other work unless expressly included

.• Customers should inspect delivered/installed work and promptly report visible issues; this does not remove statutory rights

10. Material care and normal ageing

Wood and other materials may change with humidity, temperature, sunlight and normal use. Customers must follow supplied care instructions. Damage caused by misuse, unsuitable cleaning products, abnormal moisture, heat, impact, unauthorised modification or failure to follow care instructions may fall outside an applicable warranty, subject to law.

11. Defects and warranty

Any product or project warranty offered by HOV will be stated in writing. Nothing in these Terms excludes statutory consumer rights.

• Report apparent damage, shortage, incorrect items or defects promptly with reasonable supporting photographs/details.

• Where a verified covered manufacturing/workmanship defect exists, HOV may, depending on the agreement and circumstances, repair, rectify, replace or provide another lawful remedy

.• Inspection, photographs, site access or return may be reasonably required to assess a claim.

• Normal wear, natural material variation, misuse, accidental damage, unauthorised repair/modification, improper care and third-party alteration are generally outside commercial warranty unless law requires otherwise.

12. Cancellation, returns and refunds

Cancellation, return and refund rights depend on the transaction, whether the item is standard or customised, whether procurement/production has begun, the Project Agreement and applicable law. For bespoke work, cancellation after approval/commencement may result in charges for completed design work, materials, fabrication, labour, logistics, restocking and other non-recoverable commitments, to the extent permitted by law. Any refund due will be processed according to the applicable agreement and law.

13. Customer responsibilities

Customers must provide accurate requirements, measurements and site information; review and approve drawings, materials, finishes and quotations; provide safe site access; obtain permissions allocated to them; make payments when due; and use products responsibly. Customer-supplied images/drawings/references must be provided lawfully.

14. Intellectual property

Website content, HOV branding, logos, photographs owned by HOV, graphics, layouts, original design concepts, drawings and other original materials are owned by or licensed to HOV and may not be copied, reproduced, modified, distributed or commercially exploited without permission, except as permitted by law. Payment for a project does not automatically transfer copyright in underlying design files or concepts unless the Project Agreement expressly says so.

15. Customer content and project photography

By submitting photographs, drawings, measurements or references, the customer confirms they have the right to provide them for the requested purpose. HOV may photograph completed work for records and portfolio use where permitted by the applicable agreement and law. Specific confidentiality or publication restrictions should be agreed in writing before completion.

16. Third-party links and products

The Website may link to third-party sites, suppliers, manufacturers, payment providers or social-media pages. HOV does not control their content, availability, security, privacy practices, warranties or performance. Third-party purchases/interactions are governed by the relevant third party's terms.

17. Website availability

HOV aims to keep the Website accurate and available but does not guarantee uninterrupted, error-free or completely current operation. To the maximum extent permitted by law, HOV is not responsible for losses caused solely by temporary website, hosting, transmission or other technical failures outside HOV's reasonable control, except where liability cannot lawfully be excluded.

18. Limitation of liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. Subject to that, liability for a specific order/project is governed by its Project Agreement and applicable law. To the maximum extent legally permitted, HOV is not liable for indirect, incidental, special or consequential loss that is not the reasonably foreseeable direct result of a breach, including loss of business opportunity, anticipated savings or goodwill. Nothing here removes statutory consumer remedies or excludes fraud, wilful misconduct or other non-excludable liability.

19. Indemnity

To the extent permitted by law, a customer agrees to indemnify HOV against third-party claims, losses and reasonable costs arising directly from unlawful Website use, infringement through customer-supplied content, unauthorised use of HOV intellectual property or material breach of these Terms/Project Agreement. This does not apply to the extent caused by HOV's own breach, negligence, fraud or non-transferable liability.

20. Force majeure

HOV is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, fire, flood, epidemic/pandemic restrictions, war, civil unrest, government action, transport disruption, strikes, supplier failures, material shortages, utility failures, serious accidents or similar events. HOV will take reasonable steps to communicate material delays and resume performance when possible.

21. Privacy and personal data

Start Your Project may collect name, email, phone/WhatsApp, city/location, project details, budget, photographs, drawings and other enquiry information.

22. Consumer rights and grievance redressal

Nothing in these Terms is intended to deprive a consumer of rights or remedies available under mandatory Indian consumer law. HOV will maintain an appropriate channel for complaints and respond within a reasonable time.

23. Governing law and disputes

These Terms are governed by the laws of India. Complaints should first be raised with HOV in good faith. Any courtjurisdiction or dispute-resolution clause must be reviewed by Indian counsel and must not unlawfully restrict a consumer's statutory right to approach a competent forum.

24. Changes

HOV may update these Terms for changes to the Website, business practices or law. The updated version will show a revised effective date. Changes will not retrospectively alter an accepted Project Agreement except as required by law or agree

25. Severability and no waiver

If any provision is invalid or unenforceable, it will be modified or severed only to the minimum extent necessary and the remainder will continue. Delay or failure to exercise a right is not a waiver unless expressly made in writing.
